Definitions and interpretations

  • In these terms and conditions:

    Refererence to "we" and "us" is a reference to Carderoo.

    Reference to "you" is a reference to the purchaser of the goods from us.

    "Contract" means te contract between us for the sale and purchase of the Goods which incorporates these terms.

    "Goods" means the personalised postcards and other items purchased by you from us.

    "Terms" means these terms and conditions.

  • These Terms govern your use of our website; by using our website, you accept these Terms. If you do not accept these Terms or any part of these Terms, you must stop using the website. Carderoo may revise these Terms from time-to-time. Revised Terms will apply to the use of the website from the date of the publication of the revised Terms on the website. Please check this page regularly to ensure you are familiar with the current version. Additionally, you should also read Carderoo's Privacy Policy.

Order acceptance

  • All orders are final and subject to the conditions in this document. You accept these when placing an order.
  • You are not allowed to upload any images or material which is illegal or offensive in nature, including pornographic, homophobic, pedophilic, racist, blasphemous, defamatory or images showing criminal acts.
  • You must own the copyright to the image you upload. You may not copy or adapt photographs, designs or works of art which are prepared by a designer, photographer or artist who owns the copyright in those works.
  • Any uploaded images or text deemed to include such material by us, our suppliers or partners, shall be deleted or destroyed after print and no refund given to you.

Privacy

  • If you place an order, you will have to provide personal information to us. We will not disclose that information to any third party without your consent, except for the purpose of processing the order and arranging delivery.

Payment

  • All payment for Goods must be made before the Goods are printed and delivered.
  • Payment can be made by debit card, credit card or PayPal at the time of placing an order, or before placing an order if buying credits. Payment will be in full and the contract will be in force.
  • We accept various currencies, and you can choose which currency you prefer. All prices include VAT at 15% if applicable.
  • Refunds may only be given at the discretion of the management.

Purchasing credits

  • When you purchases credits, Carderoo will record the number of credits bought in your Account. We shall record when the credits are used. You may send postcards until the credits have run out.
  • Once credits are purchased, no refunds will be given to customers.

Expiration of credits

  • Credits will expire one year after the initial purchase of credits. You will not have any right to receive a refund for the expired credits.

Free credits

  • Carderoo may occasionally offer you free credits for recommending the service to others. In this case, once you have met the criteria set and earned your free credits, credits will be placed in your account.
  • These free credits will be valid for one year. After one year, these free credits will expire.

Delivery

  • The estimated delivery time for postcards arriving in the UK is 2 working days after receipt of order. For postcards being sent to the rest of the world, delivery will take between 4-6 working days after receipt of order. These are an estimate only and no times or dates provided by us are guaranteed.
  • Carderoo intends to open print stations around the world once the demand merits it. We shall update these Terms when opening new print stations outlining delivery times.
  • You must notify us if the postcard you have sent has not arrived within 14 days of being sent. In this case, we shall ask you to resubmit your order using a code provided by Carderoo and Carderoo will re-print and send the postcard again. If this second postcard does not arrive, Carderoo’s liability will cease.

Limitation of liability

  • Nothing in these terms and conditions (or elsewhere on our website) will exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law. Subject to this, our liability to you in relation to the use of our website or under or in connection with these terms and conditions, whether in contract, tort (including negligence) or otherwise, will be limited as follows:
  • To the extent that the website and the information and services on the website are provided free-of-charge, Carderoo will not be liable for any loss or damage of any nature;
  • Carderoo will not be liable for any consequential, indirect or special loss or damage;
  • Carderoo will not be liable for any loss of profit, income, revenue, anticipated savings, contracts, business, goodwill, reputation, data, or information;
  • Carderoo will not be liable for any loss or damage arising out of any event or events beyond our reasonable control;
  • Carderoo's maximum liability in relation to any event or series of related events will be limited to the purchase price of goods sold.
  • Carderoo makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive. No data transmission over the internet is totally secure. As a result, any personal details or other information, text or images you upload to, or enter into, the Carderoo website is sent at your own risk.

Indemnity

  • You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by us arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

Termination

  • Carderoo has the right to terminate your access to its website, without prior notification to you, to remove personal details or photos stored on the site, refuse to print or send postcards if it feels it necessary to do so.
  • Carderoo will not be liable for any suspension or termination of your account, except when you have credits remaining. In this case, we will refund credits to you.

General

  • Severance: If any provision in these Terms is held by a court to be unenforceable, that will not affect the remaining provisions of the Terms.
  • Entire Agreement: These Terms govern our relationship with you and in accepting them, you confirm that no other arrangement, agreement or representation applies.
  • Assignment: We reserve the right to assign any of our rights or obligations under the Contract to a third party on the basis that the existing contractual terms will become the responsibility of that third party. You will not be able to assign any of your rights or obligations without first getting our written consent.
  • Force Majeure: We will not have any liability to you if we are prevented from performing any of our obligations on account of any circumstances beyond our reason a fire, flood, act of God, terrorism, war, strike or difficulty in obtaining materials and/or labour. In any of these circumstances we reserve the right to cancel (or, at our option, to suspend) the Contract.

Links to third party websites

  • There may be links from our website to other websites. We do not accept any responsibility for the content or the use of such website. It is up to the Buyer to take precautions to ensure that whatever it selects for its use is free of such items as viruses, worms, Trojan horses and other items of a destructive nature.

Third party promoters

  • We may display or advertise related services on our website, offered by third parties. If you decide to purchase a service from a third party, your contractual relationship will be with them and not us.
  • We will make every effort to assist you if you have any dispute but will not take responsibility for any settlement or loss resulting from the dispute.

Disputes

  • If there is a dispute which we cannot settle by direct negotiation, we may require that it is referred to mediation before any legal proceedings are commenced. In that event, the mediation will be conducted in accordance with the CEDR (Centre for Effective Dispute Resolution) mediation rules current at the date of the dispute.
  • Any dispute between us will be finally determined by the English courts and you agree to submit to the jurisdiction of those courts.
